Why Bolsonaro Needs to Be Impeached
Brazil’s longstanding political crisis already looked like the worst-case scenario, but it was surmounted by a further explosive element: the COVID-19 health crisis. Populist executive leaders seem to have responded too late to the dangers of this pandemic, but all of them appear be at least aware of the political effects of their policies. Bolsonaro seems to be taking a higher risk, adopting a position that indicates that his institutional support might be vanishing and pushing him towards direct support by his popular sympathizers. The Polish Presidential Campaign in the Shadow of the Pandemic
Various types of states of emergency have been, and in all likelihood will be, introduced or at least contemplated in different states of the world to cope with the COVID 19 crisis. Nowhere is this issue more lively than in Poland which is currently in the midst of the presidential election campaign – or rather “a sort of” election campaign of a somewhat bizarre character. Viele Länder des Schengen-Raumes haben obendrein die Wiedereinführung von Binnengrenzkontrollen und absolute Einreiseverbote für Personen aus „Risikogebieten" beschlossen. Auch dies dient angeblich dazu, das Wachstum der Infektionsrate abzuflachen, zeigt aber ein ordnungspolitisch überformtes Verständnis von Virusbekämpfung, dem die notwendige gesundheitspolitische Komponente weitgehend fehlt. Gottesdienstverbot auf Grundlage des Infektionsschutzgesetzes
Die jetzt vereinbarten Regelungen für „Zusammenkünfte in Kirchen, Moscheen, Synagogen und die Zusammenkünfte anderer Glaubensgemeinschaften, einschließlich der Zusammenkünfte in Gemeindezentren“ sind verfassungsrechtlich nicht zu beanstanden, wenn sie mit Augenmaß angewendet werden. Dann sind sie verhältnismäßig. So notwendig energische Maßnahmen gegen die weitere Ausbreitung der Viruserkrankung sind: Ungern befände man sich in einigen Wochen in einem Gemeinwesen wieder, das sich von einem demokratischen Rechtsstaat in kürzester Frist in einen faschistoid-hysterischen Hygienestaat verwandelt hat. Corona Triage
Triage - this is the sorting of patients in groups to be treated preferentially or subordinately when the mass of patients vastly exceeds the available resources. It has always been a delicate and stressful procedure. The Italian Society for Anesthesia, Analgesia, Resuscitation and Intensive Care Medicine (SIAARTI) has recently given recommendations to intensive care physicians who are currently no longer able to provide lung ventilators to all Covid-19 patients in need. The aim of those recommendations was to relieve the practitioners of the burden of taking personal responsibility for the selection decisions and to make the criteria explicit and communicable. The criteria, or so the authors propose, should also be made accessible to those affected and to their families to maintain trust in the public health service. Die Nachrichten dieser Tage erwecken den Eindruck, dass das Unionsrecht in der Coronakrise ausgedient hat. Nationale Alleingänge, staatliche Egoismen und Grenzabschottungen sind an die Stelle des Binnenmarktes und des „Raums der Sicherheit, der Freiheit und des Rechts“ getreten. Vollzieht sich vor unser aller Augen ein historischer Bruch mit der EU als Rechtsgemeinschaft? Schaut eine ins home office geschickte und kompetenziell gelähmte Kommission dem Zusammenbruch ihrer Existenzgrundlage wehrlos zu? Oder ist in Wahrheit von Rechtsbruch keine Rede, weil diese Rechtsgemeinschaft genügend Instrumente vorsieht, mit denen die Mitgliedstaaten angemessen auf die Gesundheits-, Wirtschafts- und Finanzkrise reagieren können? Corona-Triage
Triage – das ist die Sortierung von Patienten in Gruppen vor- und nachrangig zu Behandelnder bei einem die verfügbaren Ressourcen weit übersteigenden Massenanfall von Bedürftigen. Das ist schon immer ein heikler und belastender Vorgang gewesen. Die italienische Gesellschaft für Anästhesie, Analgesie, Reanimations- und Intensivmedizin (SIAARTI) hat den Intensivmedizinern, die derzeit nicht mehr allen bedürftigen Covid-19-Patienten Beatmungsgeräte bereitstellen können, dazu kürzlich Empfehlungen an die Hand gegeben. Man wolle auf diesem Wege die Praktiker davon entlasten, die Auswahlentscheidungen persönlich verantworten zu müssen, und man wolle die Kriterien explizit und kommunikabel machen. Die Sache wird ernst: Die Infektionszahlen schießen nach oben, das soziale Leben kommt zum Erliegen, nun mehr und mehr auch in Deutschland. Veranstaltungen werden abgesagt, Einrichtungen geschlossen, freiwillig, aber auch aufgrund behördlicher Anordnung. Die Länder sind vom Empfehlungsmodus in den Verbotsmodus gewechselt. Coronavirus Emergency and Public Law Issues: An Update on the Italian Situation
The emergency caused by the “new” Coronavirus disease (that we discussed here) reached a new peak in Italy in the last few days, since cases have tripled compared to just a couple of days ago. On March 7th, a new Hungarian law came into force, allegedly intended to stop the “abuse” of compensation claims due to inhuman conditions in prison (“abuse law”). Even if this turns out to be yet another populist gimmick, the new legislation has important ramifications for the rule of law in Hungary because it sends the message to the citizens and the courts that the finality of judgements and court rulings are relative. The legal and political consequences of the Hungarian government’s campaign against an appeal judgment which ordered the payment of compensation for school segregation can reverberate across the EU, because of the ubiquitous nature of segregation. Should the Hungarian government prevail, the case may negatively impact the integration of minorities in other Member States as well, particularly if the European Commission fails to increase its efforts to enforce the Racial Equality Directive. Wem die Aktuelle Stunde schlägt
Im Brandenburger Landtag hat der von der AfD nominierte Landtagsvizepräsident Andreas Galau versucht, die kurzfristige Anberaumung einer Aktuellen Stunde zum Thema „Walter Lübcke, Halle, Hanau – Wehrhafte Demokratie in der Pflicht“ durch sein Veto zu verhindern. Das Verfassungsgericht Brandenburgs hat Galau einen Strich durch die Rechnung gemacht und im Wege einer einstweiligen Anordnung die Durchführung erzwungen. In der Tat ist es folgerichtig, dass ein Landtagsvizepräsident allein auch in Eilfällen nicht über die Tagesordnung des Parlaments bestimmen kann. Möglicherweise wäre eine Anrufung des Verfassungsgerichts aber gar nicht notwendig gewesen. Continue reading >>
